MBI is also permanently deregistered in the state's Office of Business Licenses which may prohibit it from being registered at any other location in the future. MBI is also designated a “significant impact” under EAC Order 20080111(2)-09-04 (5-13-2012). DEQ has determined that MBI failed to submit a full and complete Environmental Assessment because it improperly relied on information from an unqualified third party, misrepresented certain financial information regarding its operations, failed to adequately review a draft Environmental Assessment prior to its submission to EAC, and made significant changes to an original Environmental Assessment that were not appropriate. DEQ also issued MBI a cease-and-desist order. DEQ also issued an order revoking the MBI license for a period of two years and issued a proposed consent order in response to MBI's actions. MBI filed a complaint with the Michigan Administrative Law Review Board and requests a preliminary determination in accordance with the Administrative Procedures Act, MCL 533.2102 to 533.2691. MBI also filed requests with the Michigan State Board of Nursing regarding the revocation of its license and the establishment of an emergency medical response committee for MBI that would provide for additional protections for MBI employees. DEQ has taken administrative action against MBI in violation of Michigan Administrative Procedures Act, MCL 34.973 to 34.9921. The department also issued orders revoking the MBI license in violation of Michigan Administrative Procedures Act, MCL 34.
